Terms of Service

By accessing or using the Service, you represent that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into a contract, and agree to comply with these Terms and all applicable laws and regulations.

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by email or an in-product banner) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

ChartMystic provides analytical tools for traders, including:

• Atlas Pro — a suite of TradingView indicators that highlight market structure, smart money concepts, order flow, liquidity, and multi-timeframe context.
• Scribe Studio — an AI assistant that converts plain-English descriptions into production-ready PineScript for TradingView.

The Service is an analysis and decision-support tool. It is not a broker, not an advisor, and does not place, manage, or execute trades on your behalf. You are solely responsible for every decision you make and every order you place.

To use most features of the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must not share your account with anyone else, resell access, or use the Service on behalf of a third party without our written permission. Notify us immediately if you suspect unauthorized access.

ChartMystic is sold as a paid subscription. Pricing and billing cadence are displayed on the checkout page and confirmed in your order receipt. By subscribing, you authorize us (and our payment processor) to charge the payment method on file for recurring fees until you cancel.

• Weekly plan: billed each week on your anniversary date. You may cancel at any time; cancellation takes effect at the end of the current billing week.
• Annual plan: billed once per year up front at a discounted effective rate. You may cancel at any time; access remains active until the end of the current annual term, after which it will not renew.

All fees are exclusive of applicable taxes, which may be added to your invoice. We may change pricing for future billing periods with reasonable advance notice; your continued subscription after any change constitutes acceptance of the new pricing.

You can cancel at any time from your account settings. Please see our Risk Disclosure for additional information about trading-related risk.

Every new subscription is backed by a 30-day money-back guarantee. If ChartMystic isn’t the right fit, request a refund from your account settings within 30 days of your initial purchase and we will issue a full refund to the original payment method.

After the 30-day window, refunds are not guaranteed and are issued at our discretion. Renewal payments (weekly or annual) are not automatically refundable; if you forget to cancel before a renewal, submit a request from your account settings and we will do our best to make it right on a case-by-case basis.

The Service, including all software, indicators, scripts, content, designs, logos, and documentation, is owned by ChartMystic or its licensors and is protected by copyright, trademark, and other intellectual-property laws.

Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal or internal business trading activity. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from any part of the Service, except as expressly permitted by these Terms or applicable law.

PineScript generated for you by Scribe Studio is yours to use on TradingView for your own trading. You may not resell, relicense, or redistribute Scribe Studio outputs as a paid product that competes with ChartMystic.

You agree not to do any of the following:

• Use the Service to violate any law, regulation, or exchange or broker rule.
• Attempt to gain unauthorized access to any part of the Service, related systems, or other users’ accounts.
• Scrape, crawl, reverse engineer, or systematically extract data from the Service except as expressly permitted.
• Interfere with, disrupt, or place unreasonable load on the Service or its infrastructure.
• Use the Service to build a competing product, train competing models, or circumvent subscription fees.
• Upload, transmit, or generate content that is unlawful, harassing, abusive, defamatory, or that infringes on anyone’s rights.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

Nothing in the Service — including indicators, alerts, AI-generated code, charts, bias readings, or documentation — constitutes investment advice, a recommendation to buy or sell any security or instrument, or a solicitation of any transaction. We are not registered as an investment advisor, broker-dealer, or financial planner in any jurisdiction.

Trading in markets involves substantial risk of loss and is not suitable for every investor. You are solely responsible for evaluating the suitability of any trade and for your own research, risk management, and execution. See our Risk Disclosure for more detail.

The Service integrates with third-party platforms, including TradingView and our payment processor. Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for third-party services, and we cannot guarantee their availability, accuracy, or security.

TradingView and related trademarks are the property of their respective owners. ChartMystic is not affiliated with, endorsed by, or sponsored by TradingView.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any indicator, signal, AI output, or analysis will be accurate, profitable, or suitable for your situation. Past performance is not indicative of future results.

To the maximum extent permitted by law, ChartMystic and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, trading losses, revenues, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

In all cases, our aggregate liability to you for any claim arising out of or related to the Service will not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations; in those cases, these limits apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless ChartMystic and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if the Service is discontinued.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, liability limitations, and governing law) will survive.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you have under mandatory consumer-protection laws in your country of residence.

These Terms constitute the entire agreement between you and ChartMystic regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect.

Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
